TO US BY HIM.


BEFORE VOTING FOR CHARLEVOIX COUNTY CIRCUIT COURT JUDGE, WE HOPE THE VOTERS WILL ASK THEMSELVES IF THEY REALLY WANT SOMEONE WHOSE HUSBAND GETS INVOLVED IN A DRUNKEN DISPUTE AT A PUBLIC VENUE.

WHY WAS HER HUSBAND ALLOWED TO REFUSE A PBT AFTER ADMITTING TO DRINKING AND WHO DROVE THEIR BOAT BACK TO SHORE?

IS THIS THE BEHAVIOR OF SOMEONE YOU WANT MAKING DECISIONS FOR YOU AND YOUR FAMILY?

WHY WAS THE SITUATION ALLOWED  TO ESCELATE TO THE POINT WHERE KUR'S HUSBAND FELT THE NEED TO SLAP AN INTOXICATED WOMAN?

REPORTING OFFICER NARRATIVE


Intoxicated female was reported as vomiting and creating a disturbance with occupants of a neighboring boat. All parties and individuals involved were interviewed. Involved persons were seperated and later declined wishing to pursue charges.

NARRATIVE

Charlevoix County Marine Deputies were dispatched to an intoxicated subject on Lake Charlevoix on July, 19. 2014, Charlevoix city park was venue for Aquapalooza event. 
911 reported she was struck by a male on an adjacent boat. reported to dispatch she had been throwing up over the side of her boat and the male did not like it and struck her.

 Marine Deputies made contact with reported boats tied together in the venue location and gathered initial statements.

Deputy Smithburg arrived at Lake Charlevoix Ferry Beach and observed multiple boats tied together in the designated area on the water. Boat reported to be involved with boat name "no camo" was observed. Marine deputies arrived and spoke to occupants. Boat "no camo" was later discovered to not be involved.

Marine Deputy Heckman came to a marine dock and informed Deputy Smithburg of statements made by occupants of the boats. Deputy Heckman reported statements were made that the female was very intoxicated and had thrown up on the boat tied to the boat she was on. She began yelling and saying profanity to the neighboring boat occupants she had thrown up on. Upon the owner of the boat returning he spoke with her and she began yelling at him and smacked him across his face. She continued to yell and spit on him then stuck him again. Deputy Heckman stated Vincent Left told him he smacked her back in self-defense.

REPORTING OFFICER NARRATIVE


I was brought to shore and spoke with Deputy Smithburg. S. stated she was very intoxicated and was hit by an unknown male across her face. Deputy Smithburg asked why she was hit.
  
                                                                     S.  stated she was very drunk and did not know why she was struck. Deputy Smithburg asked her what happened prior to her being struck. S. repeated  she  did not  know.  

  Deputy Smithburg could not see any visible mark from being struck. Deputy Smithburg asked S. if she had thrown up on his boat.S. stated she was very drunk and had thrown up. Deputy Smithburg asked S. if she yelled at anyone, she stated she could not remember. S. stated she got hit and called 911.

Deputy Smithburg asked if she would take a preliminary breath test. S. stated she was intoxicated
and old enough to be drunk. Deputy Smithburg asked again for safety concern. S.was  observed  to be
heavily slurring her words, had a hard time keeping balance, spoke with the odor of intoxicating beverages on her breath, had blood shot eyes and nearly removed the upper part of her swim suit when removing her lifejacket.



 Based  statements of being wasted, Deputy Smithburg again requested a Preliminary breath test.S. became emotional and began to argue submit a  breath sample with results of ***  17:34 hours.

asked who owns the boat she was on.stated her friend Stephanie's dad, she did not know their last name.S. wanted the man that hit her arrested. Deputy Smithburg stated he would speak with the person.



became upset and stated nothing was being done. Deputy Smithburg asked     if she wanted to write a statement, she was too drunk. Deputy Smithburg provided his card with report number to Deputy Smithburg adviseD    be would speak with the male.                                                              

was asked by Deputy Smithburg if she could call a person to pick her up. Deputy Smithburg advised he did not want her returning to the boat.
S. argued about going back to the boat. Marine Deputy Mapes advised the occupants on the boat told him not to allow S back on the boat. Deputy Smithburg asked S. if someone could pick her up.
S.stated someone was coming to get her between 10-11 pm and she would wait on shore for them. then began to argue and wanted to go back out on the boat. Deputy Smithburg advised  S. to go shore. She stated she was going to stay on the dock. Deputy Smithburg advised S. go to shore because she was on a private dock at the current time. S. walked to shore.



CONTACT WITH LEFT


Deputy Smithburg got onboard with Marine Deputy Mapes and was transported out to where the boats were tied together. Vincent Left was asked to get onboard the Charlevoix County boat to speak in private away from the venue of boats. Deputy Smithburg asked Left to explain the events. Left stated he was called back to his boat after being informed an intoxicated female had puked onto his boat. Left stated he was told the intoxicated female (s) was yelling at people on his boat and called his wife a -----. 


                                                                                                                              Left stated he spoke with S from his boat to the boat she was on.S. began yelling at him and struck him in the face. Left stated he told her not to throw up his boat she spit on him and stuck him again,
     Left stated he smacked back at her in defense.
    Left was asked by Deputy Smithburg to take a preliminary breath test. Left refused and stated he had four beers.

Left started to write a written statement then stated he did not want to complete it. Deputy Smithburg asked Left if he wanted to press charges against S. 
    Left stated he did not want to press charges he was over and done with it. 

Left asked if she was pressing charges, Deputy Smithburg advised him yes. Left stated then he wanted charges pressed. Left was asked who was on his boat. 





Left Stated his wife (Mary Beth Kur) and Left stated he did not know S.
     Left requested to go back to his boat. Left was transported back to his boat.



REPORTING OFFICER NARRATIVE



Deputy Smithburg spoke with Mary Beth Kur. Kur stated S. was in the boat next to hers and was intoxicated.

 Kur stated Springer threw up over the side of her boat. Kur Stated she told her not to throw up on her boat and she replied back



" I will projectile vomit all over your boat you  F****** C***


  Kur stated upon Vincent Left returning. S stuck him twice in the face, then S. called 911.



Deputy Smithburg requested Kur to complete a written statement, she agreed. 

Kur stated owner of the boat S. came from was *****and he was below deck on his boat. Deputy Smithburg requested written statements from the other persons on the boat, Kur stated she would get statements to Deputy Smithburg.

Investigation. Both Parties decline pursuing charges upon follow up investigation.
