In
response to the libelous and slanderous statement about me personally by former
Genesee Prosecutor Art Bush and published by Ms. Kur, I feel I have no choice but
to respond.
I
want to state yet again that I do not know either candidate that is running for
Judge in Charlevoix County, I have never spoken to Ms. Kur (even in Court when
she was a prosecutor) or Mr. Hayes. I do not support any candidate; I have not
made the flyers that have been falsely and maliciously attributed to me but it
is interesting that Ms. Kur posted part of the flyer and left out the part that
claimed she cost the county MILLIONS of dollars.
First
and foremost, Mr. Bush states “Ms. Beal’s version of history is blatantly
false”, “Miss Beal clearly does not have the knowledge of the case or its
details or she would not make such unfounded personal attacks” and that he was
the Chief prosecutor in this case.
- I
have been provided a copy of the transcript of Ms. Kur’s testimony from this case and it clearly states that Mr.
Daniel Stamos and Mr.
DeGarmo were the prosecutors in the case for at least Ms. Kur’s
testimony.
- My
version of the “history” comes directly from the sworn testimony
of Ms. Kur given under oath on Thursday October 30, 1997 in
front of the Honorable Robert M. Ransom in Flint Michigan.
Mr.
Bush states “It is well documented that long before she went to law school,
Mary Beth was first to gather the courage and strength to come forward and file
tenure charges against Crear in 1986..”
- The
transcript provides:
Question: Mr. Stamos “Okay. You had come forward in 1987 to the
Flint School Board, had you not?”
Answer: Ms. Kur
“Yes I did”

the “fact” that Mr. Bush states that Ms. Kur came to the School board long
before she was in law school:

Law in 1990. (It is believed Ms. Kur went to law school at night

is interesting to note that Ms. Kur’s Facebook page states:
She spent the next 13 years as a prosecutor before opening her own private
practice in 2004

- Now taking Ms. Kur’s SWORN TESTIMONY from the transcript, she was a “prosecutor from May 1992 until she opened her own office in 2004 [I take that to mean she opened her private
office while still the sitting prosecutor] which is
11 ½ years and not the 13 she claims.
She spent the next 13 years as a prosecutor before opening her own private practice in 2004
- Lastly, Kur didn’t open up her own practice in 2004 but worked for the Firm Schmoll, Martin & Kur, PLLC in Petoskey, Michigan. A review of her PLC filings shows that she filed for her own office on August 8, 2006.
What is the
truth?
For someone who want to be a
Circuit Judge, at least they could be honest on where they worked, who they
worked for and what experience they have.
Mr. Bush states “She then spoke out loudly and strongly
to Crear’s employer in Florida but once again, no one in a position of
authority did the right thing… until tragedy struck again in 1995.

Ms. Kur “Yes I did”

Since Mr. Bush brought this to the attention of the public
and Ms. Kur posted his slanderous letter on
her Facebook page, I will let the people decide.
Is Mr. Bush correct
or is the SWORN TESTIMONY UNDER OATH correct?
- I do find it somewhat troubling that Mr.
Bush states that the Florida school investigators discovered
notes IN THEIR OWN FILES
documenting multiple calls from Mary Beth Kur and her father, when the SWORN TESTIMONY of Ms. Kur states
she made “a” call “anonymously”.
Who is correct?
Mr. Bush states “the claims made online and over the
airwaves are that Mary Beth Kur is to blame for Crear’s abuse and manipulation
of other children to wit: “Mary Beth Kur went to law school, was an attorney
and did nothing to stop a pedophile from abusing other girls. One girl committed suicide while she sat back
and did nothing.”
- Ms. Kur went to law school- that is fact
- Ms. Kur was an attorney in 1990, worked
in private practice with Gault Davison, although she conveniently
forgot this on her facebook
page, and was employed as an assistant prosecutor in Genesee County in May of 1992 and then
Charlevoix County until 2004.
- Mr. Bush calls George Crear a pedophile-
that is apparently true
- The Transcript states:

remember the light bulb sort of going off in my head that this
was not a healthy, good
relationship…. and I was older and I knew.
And I thought
about that at like 18 or 19, but I never did anything
about it until later”

- Ms. Kur, at 18 or 19 was in college at
the University of Michigan when the light bulb went off. Transcript
- Ms. Kur was an assistant prosecutor from
May 1992 until 2004.
- The transcript reveals that Ms. Kur knew
this pedophile was having inappropriate sexual
relations with high school girls because it happened in front of
her.

- What is important is this:
- Ms. Kur was an attorney in 1990- I may be
wrong but I believe you learn criminal law while in
law school. She was well beyond the 18 or 19 years old
when “the light bulb
went off”
- If you take Ms. Kur’s claims as true that
she has 13 years of prosecution experience [she
claims on her facebook that she
graduated in 1990 took the bar exam and spent the next 13 years in prosecution] that means that she was in prosecution from
1991-2004- which means her Facebook page
is not true or her testimony is not true.
- The transcript reveals that Ms. Kur
testified that she “believes that she handled a
preliminary exam for a criminal sexual conduct case” while an
assistant prosecutor in
Genesee County. Page 533 line 24-24
- In any event,
- she knew of Crear and his behavior for a
long time, - true/testimony
- the light bulb came on when she was 18 or

- She knew Crear was with at least one other
girl. - testimony
- She knew he moved to the Miami school
system [she called one time anonymously]- testimony
- If Mr. Crear is the pedophile that Mr.
Bush claims him to be, does Ms. Kur really
believe that he would miraculously stop his ways when he moved
to teach in
another school district?

Medical School, July 2010 there is no
cure for this type of behavior
- A girl in Florida, 16 years old,
committed suicide in 1992
because she thought Crear had spurned her, according
to testimony during a 7 day trial.

I have never blamed Ms. Kur for the actions of Mr. Crear
nor would I. Those actions are reprehensible and he is in
prison where he should be.
The transcript and all of its sordid details

actions, was an attorney and by her claims, a prosecutor, and also by her
claims made one anonymous call to stop this guy and after knowing this man went
to another school, a girl committed suicide.
It is Ms. Kur that is touting her “prosecutorial
experience” and that she has been “a voice for victims”, “she has what it
takes” etc. Is this true or misleading
to the public?
Did she do enough to stop
this person? Could she have done
more? Her character, life experiences,
how she conducts herself is all in play when one wants to be elected to the prestigious
office of Circuit Court Judge.
Lastly, by publishing Mr. Bush’s libelous and slanderous
letter about me on her Facebook page, Ms. Kur has defamed my reputation. I am not a public figure; I am not running
for a public office. I simply state the
facts so that the public can make an informed decision.
The facts are the facts and the sworn
testimony is supposedly the truth, the “truth” is not what one puts on their Facebook
page.
The sole question is whether you
believe that enough was done to stop this man by not only an attorney but by a
prosecuting attorney. I don’t think so
but you are free to disagree with me.

Sad & Pathetic
Isn’t it pretty pathetic when someone could stoop so low as to take the intensely personal fact that 38 years ago, as a child, our candidate was one of dozens and dozens of children harmed by a now convicted criminal and try to twist it to their political advantage by implying that she was the cause? That is exactly what is going on here. The people who put this out there don’t care about the truth. The only objective they have is to win by personal destruction - that they try to accomplish with blatant lies. Any attempt to highlight child abuse or use an attack on the spouse of the other candidate as factors in this judicial race is shameful and illustrates politic at its absolute worst. Shame on them.
