Sheriff's Department Takes Family's Home and Contents Using a Fake Eviction

This story is unbelievable! Since I had my own experience with illegal eviction in Antrim County, I can verify that the police for the most part are no longer here to serve and protect the citizens. Special thanks to Ted Visner for sharing his story with us. Please keep them coming, readers.

(MT. PLEASANT, MI) - U.S. Navy veteran Ted Visner and his wife, Kathy Smith of Mt. Pleasant, Michigan, have been living out a nightmare. It started two and a half years ago, when the family fell victim to an apparent real estate scam by a local sheriff's department employee.

Ted Visner says they bought their former home on a land contract, only to learn seven months later, that the seller, Isabella County Sheriff's Dept. employee Shelly Sweet, was not making monthly payments on the house. A bank foreclosed on the property, all unbeknownst to the Visner/Smith family.
Ted Visner, who builds custom homes for a living, said, "Although we were paying Sweet every month on the purchase of the property, she had not been paying the underlying mortgage and the home fell into foreclosure." I asked Visner if he had records of those payments, he said he does, including canceled checks. You won't believe what happened next.
"On a weekend Sweet knew that we would be out of town, she offered the contents of our home to her friends and coworkers at the Isabella County Sheriff’s Department, claiming we had abandoned the home. Many took her up on her free offer deal and took over $55,000 dollars worth of our personal property."

  1. Her claim that they had abandoned their property was legally what is known as 'heresay' and it is NEVER admissible in a court of law. To take someone's property the person should have announced in a legal document in a paper of record that this was the case! You have to do this if you are trying to find absent parents or posting a notice that you are not responsible for your children's debts. Right now, the government-both federal and state-is doing what it dam well wants. This has to stop as there is no rule of law anywhere thanks to Obozo!

  2. Shelly Sweet also admitted in a deposition under oath that she never made any attempt to ask us if we had abandoned the home and it's contents when she had all of our phone numbers.

  3. Lesson Learned - Never buy real property of such major proportions as a house with and unrecorded contract. Had it been recorded they would have gotten notices of the pending foreclosure. As it is there is a question of full disclosure of other interests by the seller/foreclosee here. I think she must have been asked to sign affidavits as to other interests in the property. The foreclosing lender must have inspected the property and noticed that someone was living there. How long were the Visners gone? Foreclosures don't happen over nite. The stolen personal property it another matter.

  4. No matter the outcome; file trespassing and thief charges against everyone who took anything from your house. Fraud against the seller in excess of $10,000.00 is a federal cause or you do it in a District Court ASAP. One Civil action against all involved as a collective working in tandum. Bank owns house; all payments go into an escrow account with the filing court to protect your interests upon a hearing. Only YOU have to file a CHANGE OF VENUE...not the crooks! No reason to do this with a corrupt system. You can appeal all judgements to a jury within a certain time limit. Try to do it now! Move it to District Court ASAP. File complaints with State Police or Police Deptartment over the Sheriff's department. Remember to sign all complaints! And get copies. Call NBC, FOX, ABC your state station-get it live instead of written in papers; contact your district state and Federal Congress representatives in writing! Put their names in the news after you do this. Make an issue! Go on fundraiser and ask for $ for defense to save your home! Other sites can help you too! Hire sharpshooter lawyer from big city with State Capitol connections if possible...they are expensive. Or, just walk the walk and walk away. Build an underground house taking all your wood and supplies on some new land away from the devil's playground. Your CALL!

  5. Why has Kathy smith had a mortgage on the property since 2007? It doesn't make sense with the Land contract story. Is the property in question on Fremont Rd in Blanchard?

  6. Ted Visner is lying about his 2010 eviction. He had his day in court. Actually he had multiple days in court over it. Two weeks before the alleged incident, Visner's "wife" testified they vacated the property. http://mfi-miami.com/?p=27294

  7. Yea... we had our day in court from September 28, 2011 through May 2013 and earned a solid default against one of the defendants when the case was arbitrarily dismissed by Paul Chamberlain.

    "Two weeks before the alleged incident, Visner's wife testified they vacated the property." Where is this testimony that you keep wanting to rely upon and lead others to believe actually exists?

    Listing an alternate mailing address (that wasn't under attack) is not testimony that we had vacated as you would like to believe and as you would like others to believe. You are pathetic and you are going to lose. Suck it up buttercup!
