EPA To Control Private Streams And Creeks

(Tara Dodrill) Proposed EPA regulations could soon impact how you use streams on your own land.
The controversial Environmental Protection Agency proposals, previously reported byOff The Grid News, were listed as priorities on the White House’s 2013 fall regulatory agenda released in late November.
The proposals would define “waters of the United States” under the Clean Water Act as including not only rivers and lakes but also streams, because the EPA says, streams are “connected to and have important effects on downstream waters” – that is, rivers and larger bodies of water.
EPA’s definition of streams would include large and small creeks and streams and also seasonal creeks and streams, the proposal said. The proposal further said that wetlands and open-waters in floodplains of streams and rivers “are integrated with streams and rivers.”
There are 3.5 million miles of rivers and streams in America, according to the EPA. No doubt, thousands if not a few million homes on private property reside next to streams, which often run through what homeowners would call ditches.
The White House regulatory agenda said the Clean Water Act contains language that, because of court rulings, has led to uncertainty. The law “could benefit from additional clarification through rulemaking,” the EPA said.

TSA agent confiscates sock monkey's pistol

"Rooster Monkburn" the cowboy sock monkey is without his pistol, thanks to a diligent TSA agent in St. Louis.

Phyllis May of Redmond, Wash. says she is “appalled and shocked and embarrassed all at the same time” about the incident that happened on Dec. 3.

May has a small business selling unique sock monkey dolls. She says she and her husband were on their way from St. Louis to Sea-Tac and she had a couple of monkeys and sewing supplies with her in a carry-on bag.

“His pistol was in there,” she says of the sock monkey “Rooster Monkburn,” a take-off on John Wayne character “Rooster Cogburn” from the film “True Grit.”

Judge Dismisses Criminal Charges Against Hartmann in Minnesota

At a hearing for Gibbon dairy farmer Mike Hartmann, Sibley County District Court Judge Erica H. McDonald dismissed five of six criminal charges brought by the state against Hartmann for violations of the Minnesota food and dairy code. Two of the charges arose from evidence seized during a December 4, 2012 stop of Hartmann’s vehicle by a state trooper; the other three came from the execution of a search warrant by Minnesota Department of Agriculture (MDA) officials on January 9, 2013 at Hartmann’s farm.
The key to the dismissal of the charges was Judge McDonald granting a motion to suppress any evidence obtained during the vehicle stop by state trooper Joseph Heyman who testified that he initially stopped Hartmann’s truck because he did not see a rear license plate on the truck and the truck appeared to the state trooper to be a commercial motor vehicle that did not have the required Department of Transportation markings or number.   Heyman subsequently conducted three warrantless searches of the vehicle during the stop, seizing raw milk and raw cheese from Hartmann’s truck at the instruction of MDA; the discovery of the food led to the granting of the warrant for the January 9 search on the Hartmann farm.
In granting the suppression motion filed by Hartmann and his attorney Zenas Baar, Judge McDonald held that while the initial stop was legal, Heyman’s searches of the truck were not because there was no probable cause that Hartmann had committed any crime. The state trooper admitted that he quickly discovered after the stop that there was a rear license plate on the vehicle. The judge found that Hartmann’s truck was not a commercial vehicle under Minnesota law and therefore that any state statute allowing for spot checks of commercial vehicles was inapplicable. Judge McDonald ruled Heyman “impermissibly extended the scope and duration of the stop.”
Since it was the illegal search of the truck that led to the execution of the search warrant on the Hartmann’s farm, the judge also held that any evidence obtained from the January 9 search was inadmissible as evidence. With the state having no other evidence on which to rest any of the criminal charges against the farmer, MDA is still searching for a way to put Hartmann out of business–something the department has been unsuccessfully looking to do for many years.

‘More smoke than fire’: Fracking’s economic benefits are overblown

Local communities that are involved in fracking of natural gas should get the greatest say whether or not such methods of gas extraction are safe, Adam Briggle, a professor at the University of North Texas and an environmental activist, told RT.
RT: There are a lot of studies that say fracking is dangerous. Why do you think some countries think it is worth the risk?
Adam Briggle: I think that is because there are benefits to go along with the costs. I think there are economic benefits at stake. I just think that these countries might have a skewed perspective of what the risks and harms really are. They may not know what it will look like until it’s in practice and as we’ve seen down in Texas, at that point it’s really too late.

Man Arrested for Fishing Will Not Be Subdued, Judge Finally Storms Out

A Montana man was arrested for fishing without a license and resisting arrest earlier this month. When he went to court for the charges, something astonishing happened. Ernie Tertelgte says he’s being wrongly persecuted for trying to feed himself. In court, he argued that the court did not have the authority to charge him, citing “natural law.” In court, he told Three Forks City Judge Wanda Drusch: “I am a living man protected by natural law and I have the right to forage for food when I am hungry… You are trying to create a fictitious, fraudulent action.” A heated exchange ensued, and the judge told Tertelgte to shut up. Then he yelled: “Do not tell me to shut up! It was by chance that the case was assigned to David Clark, one of several attorneys on the court-appointed defense roster for indigent clients in the 86th District Court.

Clark has been around for years, he fights tenaciously for his clients, and he is confined to a wheelchair.

It happened that his newest client, William Shaw Lyon, also uses a wheelchair. Although Lyon can walk, he suffered a closed head injury and a foot injury and has trouble getting around.

At first, Clark said he thought Lyon’s charges stemmed from a run-of-the-mill drunk driving case. He thought Lyon was caught drunk on a moped. As he got involved, though, he discovered this was no ordinary case.

Lyon was charged with third-offense drunk driving for operating what is essentially a motorized wheelchair on Garfield Avenue on the evening of Sept. 8.

“I probably took it a little more personally than someone else would,” Clark said.

Financial advisor and evangelical Christian Dave Ramsey probably wasn’t expecting this much pushback when he shared a piece contrasting the  habits of the rich with those of the poor. In her  response on CNN, Rachel Held Evans noted that Ramsey and Corley mistake correlation for causality when they suggest (without actually proving) that these habits are the  cause of a person’s financial situation. (Did it never occur to them that it might be the other way around?)

Ramsey fired back, calling the pushback “immature and ignorant.” This from a guy who just made 20 sweeping assertions about 47 million poor people in the US — all based on a survey of 361 individuals.

That’s right. To come up with his 20 habits, Corley talked to just 233 wealthy people and 128 poor people. Ramsey can talk all he wants about Corley’s research passing the “common-sense smell test,” but it doesn’t pass the “research methodology 101” test.

International Law Encourages Use of Geoengineering Weather Modification

According to a new study due to be published in 2014, Geoengineering field research is not only allowed, it is encouraged.

The study was authored by Jesse Reynolds at Tilburg Law School in the Netherlands. Reynolds researched the legal status of geoengineering research by analyzing international documents and treaties.

Geo-engineering is the science of manipulating the climate for the stated purpose of fighting mad made climate change. These include Solar Radiation Management (SRM), the practice of spraying aerosols into the sky in an attempt to deflect the Sun’s rays and combat climate change.

According to a recent congressional report:

“The term “geoengineering” describes this array of technologies that aim, through large-scale and deliberate modifications of the Earth’s energy balance, to reduce temperatures and counteract anthropogenic climate change. Most of these technologies are at the conceptual and research stages, and their effectiveness at reducing global temperatures has yet to be proven. Moreover, very few studies have been published that document the cost, environmental effects, socio-political impacts, and legal implications of geoengineering. If geoengineering technologies were to be deployed, they are expected to have the potential to cause significant transboundary effects.

In general, geoengineering technologies are categorized as either a carbon dioxide removal (CDR) method or a solar radiation management (SRM) method. CDR methods address the warming effects of greenhouse gases by removing carbon dioxide (CO2) from the atmosphere. CDR methods include ocean fertilization, and carbon capture and sequestration. SRM methods address climate change by increasing the reflectivity of the Earth’s atmosphere or surface.

US school children now don’t need to do anything wrong ~ to be forced onto mind-altering psychotropic drugs. “We were told that if we did not follow-up their evaluation for ADHD and take him to the pediatrician and get him on Ritalin: That child protective services could charge us for “educational and emotional neglect”. @4min 40 sec.

Americans Want Congress Members To Pee In Cups To Prove They're Not On Drugs

WASHINGTON -- While most Americans like the idea of drug testing for welfare recipients, they LOVE the idea of drug testing for members of Congress.
According to a new HuffPost/YouGov poll, 64 percent of Americans favor requiring welfare recipients to submit to random drug testing -- a measure pushed by Republican lawmakers in recent years -- while 18 percent oppose it. But an even stronger majority said they're in favor of random drug testing for members of Congress, by a 78 percent to 7 percent margin. Sixty-two percent said they "strongly" favor drug testing for congressional lawmakers, compared to only 51 percent who said the same of welfare recipients.

TSA Expands Searches of Parked Cars at Airports

Sign says vehicles “will be searched by uniformed security”

TSA-approved warrantless searches of vehicles parked outside airports are being expanded, with a photograph taken at Birmingham-Shuttlesworth International Airport informing Thanksgiving travelers that all vehicles belonging to AmeriPark customers “will be searched by uniformed security.”

The policy, which first came to light earlier this summer after complaints from people who found notes inside their car which read, “your vehicle has been inspected under TSA regulations,” continues to cause confusion and stoke concern amongst privacy advocates.

When the story first broke, the TSA was keen to deflect responsibility by explaining that although, “the plan is approved by the TSA, it is up to each airport authority and its state and local law enforcement partners to follow the plan that has been implemented.”

The sign above, originally posted by Young Americans For Liberty, suggests that airport uniformed security guards are responsible for carrying out the searches at Birmingham International, not valet parking staff. The image was taken on November 27, the day after Thanksgiving and one of the busiest travel days of the year.

Cruelly, she was allowed to hold her newborn baby only briefly. She was instructed not to breast-feed her, and has seen her beloved child just ten short times since the horrific birth.

Family of 11 'pedophiles' arrested in case of missing Alabama teen Brittney Wood, 19, including her mother and brother on charges of sodomy and rape

Nearly a dozen members of the same Alabama family – including the mother and brother of a missing teen - have now been arrested on sex abuse charges in a case that’s shocked the nation.

The arrests are linked to missing mother-of-one Brittney Wood, 19, who hasn’t been seen since she left her Theodore home, just outside Mobile, to visit her uncle, Donnie Holland, in the Styx River area, on Thursday May 31, 2012.
She was last seen in a car with Holland at Tillman's Corner. Two days later he committed suicide.

Since then 11 people, either members of the Wood family, or with direct links to it, have been arrested on charges including rape, sex abuse with children under 12, incest and sodomy.
The suspects in the sex ring include Brittney’s mother, Chessie Wood, her brother, Derek Wood, Nelton ‘Butch’ Morgan, Dustin Kent, William ‘Billy’ Brownlee, Mendy Kent, Wendy Holland, James Cumbaa, Randall Scott Wood and Jennifer Moore, the most recent arrest.

Detectives believe that Brittney may have gone to visit her uncle to confront him about sex abuse and have voiced their frustration that the one person who may be able to shed light on the alleged crimes has disappeared.

However, among the largest audience, the television audience, JFK won hands down and history was changed. JFK’s charismatic appeal was something that the elite had underestimated. The insiders were left to deal with the son of a criminal and most likely they thought they could work with the son of the Adolph Hitler supporting and bootlegging thug.

Japanese (And American) Governments Go to Extreme Lengths to Cover Up Fukushima and Other Disasters

Japan and the U.S. are doing everything they can to cover up the danger of the Fukushima crisis.

The Japanese government, which already has a long history of cover-ups and opaqueness, is on its way to becoming even less open and transparent after the lower house the Diet, Japan’s parliament, passed the Designated Secrets Bill on Tuesday. With new powers to classify nearly anything as a state secret and harsh punishments for leakers that can easily be used to intimidate whistleblowers and stifle press freedom, many in Japan worry that the if the bill becomes law it will be only the first step towards even more severe erosions of freedom in the country.

Even politicians inside the ruling bloc are saying, “It can’t be denied that another purpose is to muzzle the press, shut up whistleblowers, and ensure that the nuclear disaster at Fukushima ceases to be an embarrassment before the Olympics.”

The new law would enact harsher punishment to leakers and ominously would allow journalists who obtained information by “inappropriate means” and whistleblowers to be jailed for up to ten years. The law would also allow the police to raid the offices of media organizations and seize evidence at their discretion.

The bill has even grants no longer existent agencies the power to classify secrets.

Despite the bill’s enlargement of the state’s power over information, it contains no oversight process to act as a check on ministries and government agencies designating large amounts of information as ‘secret’ for capricious or self-interested reasons.

Masako Mori, the Minister of Justice, has declared that nuclear related information will most likely be a designated secret. For the Abe administration this would be fantastic way to deal with the issue of tons of radiated water leaking from the Fukushima Daichi Nuclear Power Plant since the triple meltdown in March of 2011. There seems to be no end to stopping the toxic waste leaks there but the new legislation would allow the administration to plug the information leaks permanently.

The newborn was taken into state care on the orders of a judge in the notoriously secretive Court of Protection – despite the mother’s pleas to be allowed to raise her.
The case provoked a wave of anger from MPs and patient pressure groups, with one MP describing social workers as ‘dictators who are unaccountable and out of control’.
The treatment of the 35-year-old Italian, who arrived in Britain last summer and then fell into an episode of serious mental ill health, was condemned as extraordinary and totalitarian.
It will raise questions of how secret justice in Britain could impose an invasive medical  procedure on a foreign citizen and then seize her child, apparently without contacting the authorities in her own country.
The girl, born last August, is now close to being adopted by a British couple, despite a court hearing that her mother had recovered and was giving clear and articulate evidence as she pleaded to keep her.
The judge who heads the family courts, Sir James Munby, has said they must be open to the public, but no information concerning any element of the treatment of the Italian mother has been made public by the courts or by Essex County Council, the local authority responsible for the baby.
The case follows a series of scandals over the way justice for families is meted out behind closed doors.

New York Cop Who Bought Barefoot Man Boots Promoted To Detective

The New York City policeman who earned wide admiration last year when he bought boots for a barefoot man has a new job title.
Larry DePrimo was promoted to detective Tuesday, the New York Post reported. His father reminded the tabloid that his son's merits go beyond his kind deed, which earned DePrimo brief fame after it was captured in a viral photo snapped by an Arizona tourist.

While the attention has waned, "I don’t think the effects it had on people has ever stopped,” DePrimo told the Post and other outlets. "I still will get ‘what you did inspired me to do a great thing for another person,’ that’s fantastic."
On the frigid night of Nov. 14, 2012, DePrimo spotted a man without shoes near Times Square. The officer walked to a Skechers store blocks away and paid $75 for winter boots and socks. He returned to the man, later identified as Jeffrey Hillman, and put the thermal gear on his feet. "He smiled from ear to ear," DePrimo said. "It was like you gave him a million dollars."..

Preventable Hunger in Our Land of Plenty

While many American families gather around the Thanksgiving table this week, some of us combining this year’s traditional dinners with Hanukkah feasts, a too quiet group will be left out of the national celebration. The nearly 49 million Americans -- including nearly 16 million children -- living in food insecure households will be struggling to afford the food they need. These families won’t be choosing between apple or pumpkin pie this holiday season but will face choices about paying for groceries or rent, heat, electricity, medicine or clothing for their children as they do each month -- choices no family should have to make in our nation with the largest Gross Domestic Product (GDP) in the world. Congress will be choosing how many of these desperate families and children in need to cut from life-giving and life-sustaining federal nutrition programs. In the middle of this season of gratitude for plenty, Congress has put the Supplemental Nutrition Assistance Program (SNAP, often called food stamps) on the chopping block while leaving largely intact subsidies for rich farmers and even some non-farmers.

With the decision deadline just weeks away Congress is working to bridge the gap between two dramatically different Farm Bill proposals which both include unjust funding cuts for SNAP. The Senate Bill cuts $4 billion from SNAP over 10 years while the House bill slashes more than $40 billion -- denying food to as many as six million people, including children, seniors, and veterans. The House proposal would also drop 210,000 children from school meals and cost our economy 55,000 jobs in the first year alone.

Burying the horrors of Chernobyl: Extraordinary images of giant steel arch which will shut off radioactive site as countryside remains desolate 27 years on

This is the huge steel arch that will entomb Chernobyl's reactor four, and slash the risk of another radioactive disaster.
The construction, which is one of the biggest engineering projects in history, is being built to seal off nuclear fuel buried inside reactor four which blew up in 1986.
Standing 360 feet tall, and 843 feet wide, the arch will be held together by 680,000 bolts.

Pregnant woman has unborn baby girl forcibly removed by caesarean after social workers obtain court order because she had suffered a mental breakdown

Social services forcibly removed a pregnant woman's unborn baby by caesarean section and put it up for adoption after obtaining a high court order on the grounds the mother had suffered a mental breakdown.
Essex council obtained an order allowing them to sedate the woman against her will before taking her daughter and placing it into care.
The Italian woman, who was in Britain on a work training course, claims she had not even been warned that she would be given a caesarean. It is not believed a natural birth would have posed a risk to her or the child's health.
Social workers argue they were acting in the best interests of the baby, who is now 15 months old, and are refusing to hand her back to the mother despite claims that she has made a complete recovery, The Sunday Telegraph reports.
Brendan Fleming, the woman’s British lawyer, told the newspaper: 'I have never heard of anything like this in all my 40 years in the job.
'I can understand if someone is very ill that they may not be able to consent to a medical procedure, but a forced caesarean is unprecedented.

Show up at 9:30am Juvenile Court 4125 Washtenaw Ave. November 30th Ann Arbor, MI. 48108  This is a preliminary hearing.  They took child based on all the old stuff she was charged with Unfit home, physical abuse ----ALL UNTRUE.  The home she was staying at was our home. 

This is not a ONE Person ISSUE. THIS IS A COMMUNITY ISSUE. This is kidnapping of children happening to good mothers!

If these social workers are unfit to house children, then how can they be social workers? 
The only trauma being caused was by CPS & the police.
Illegally or even legally removing a child, is going to traumatize that child! CPS only does it for the money.
I am sure CPS will try to have this video quashed in court, as they claim it is biased against them.
I know what I am talking about. My daughter was removed without a real investigation. CPS & the police were laughing when they removed her. They thought it was humorous when she called them names as the hospital security walked me out. My daughter was searched three times like a common crimiinal in front of unknowing bystanders. They thought she had done something wrong.
I hope this video is played many times, just like the video in California that showed the illegal tactics taken by CPS. The police don't even ask to see the court order, because many times CPS tells them they have a "verbal" order, which is illegal. It must be in hand & signed by the judge, not the court clerk, as happens many times.
This was an illegal kidnapping!

Family returns home from visiting dying relative to find stranger has moved into their house, changed all the locks and claimed it as HIS under obscure Ohio law

A family Ohio were in for a nasty surprised after they returned from a visit out-of-town visit to a dying relative to find someone else had moved into their house.

Their outrage has now turned into a court battle, pitting them against a man who says he has the court documents to prove the house is now his.

Robert Carr moved into the home that had been occupied for 21 years, changed the locks and emptied the house.
